互联网产业中相关市场的界定--以企业利润来源为视角

百度公司案反映出在反垄断法实施过程中认定互联网产业垄断行为的艰难。要突破相关市场界定的瓶颈,不能照搬传统方法,也不能完全束缚于反垄断法的规定,我们应该从互联网产业的双边市场特性出发,探讨合理界定相关市场方法。从需求替代性与供给替代性的角度,而不考虑平台企业的利润来源来界定相关市场存在着一些硬伤,因此,《相关市场界定指南》必须加以完善。这种完善必须建立在客观对待互联网企业所提供产品(服务)功用差异的基础上,重点考量信息获取类、交流沟通类、网络娱乐类和商务交易类等四类企业利润的主要来源。 Baidu company case reflects the difficulty of monopolizing internet industry in the process of implementing antitrust law. To break through the bottleneck defined by the relevant market, we can not copy the traditional method nor the law of antitrust law completely. We should proceed from the bilateral market characteristics of the Internet industry to explore the reasonable definition of relevant market methods. From the point of view of demand substitution and supply substitution, and without considering the profit sources of the platform enterprises, there are some flaws in the relevant markets. Therefore, the “relevant market definition guidelines” must be improved. This improvement must be based on objectively treating the differences in the functions of products (services) provided by Internet companies, with a focus on the major sources of profit for the four types of enterprises, including information acquisition, communication and communication, online entertainment and business transaction.
