我国现行物权法于2007年3月16日第十届全国人民代表大会第五次会议通过,该法第42条规定:为了公共利益的需要,依照法律规定的权限和程序可以征收集体所有的土地和单位、个人的房屋及其他不动产.为防止征收权的滥用,保护所有人的物权利益,世界各国都对征收权的发动规定了限制条件,其中主要的限制条件是征收必须符合公共利益.征收的公共利益目的不仅使征收的正当性得以确立,而且也是防止征收权滥用的一个重要措施.但是,我们在实务中如何界定公共利益呢?因此,对公共利益进行分析很有必要。
The current property law of our country was adopted at the Fifth Session of the Tenth National People’s Congress on March 16, 2007, and Article 42 of the Law stipulates: In order to meet the needs of the public interest, the collective ownership of land and Units, individuals’ houses and other realties.In order to prevent abuse of the right to collect and protect the real rights and interests of all the people in the world, all the countries in the world have set limits on the launch of the collection right, the main restriction being that the collection must be in the public interest. The purpose of public interest not only establishes the legitimacy of expropriation but also is an important measure to prevent the abuse of expropriation right.But how do we define the public interest in practice? Therefore, it is necessary to analyze the public interest.
