银行一向被人们视为财富的保管箱,被人们寄予了极大的信任,但自20世纪70代以来发生的一系列跨国银行倒闭案,使得信任危机在银行间普遍产生。巴塞尔委员会提出了双重许可的监管合作模式,以期在东道国和母国的通力合作之下,能最大限度地遏制银行风险的发生。依照GATS的有关规定,而东道国和母国有权相互评价对方的监管效果,并依此评价而背离国民待遇原则,导致金融市场准入新障碍的产生。
Banks have always been regarded as a safe deposit box by people, and have been greatly trusted by people. However, a series of bankruptcies of transnational banks that have taken place since the 1970s in the 20th century have led to the widespread trust crisis among banks. The Basel Committee has proposed a dual-licensing regulatory cooperation model with a view to curbing bank risks to the maximum possible with the concerted efforts of host countries and home countries. According to the relevant provisions of the GATS, the host country and the home country have the right to mutually evaluate each other’s regulatory effectiveness, and thus deviate from the principle of national treatment, resulting in the emergence of new barriers to financial market access.
