本文以当今热点RTAs投资规则与人权关系为主要论题。作者首先论述了RTAs投资规则与人权的关系,在此基础上对以美国和欧盟为投资规则与人权相连实践的案例进行深入的剖析:认为欧盟的“人权条款”与欧盟对外签订的包括投资和贸易在内的协议挂钩。而对美国的分析,则是以其NAFTA、AUSFTA和TPP以及2012年双边投资范本中的投资规则为实例,认为美国在签订RTAs协定时候将其中的投资规则与人权保护挂钩。中国则作为了第四个投资规则与人权挂钩的实践案例,指出中国签订的RTAs投资规则,与人权挂钩的并不多,但是随着TPP、TTIP以及中美BIT双边协定的谈判和签署,中国或许要考虑改变目前的实践状况。最后,文章分析了RTAs投资规则与人权保护在法律和政治上的发展趋势,并就国际和国内两方面提出若干可行性建议。
This article focuses on the current hot RTAs investment rules and human rights relations. The author first discusses the relationship between RTAs’ investment rules and human rights, and then analyzes the case of the connection between the United States and the EU as an investment rule and human rights. It concludes that the EU’s “human rights provisions” and the EU’s foreign agreements include Investment and trade, including the agreement linked. The analysis of the United States, based on its NAFTA, AUSFTA and TPP investment rules in the 2012 Bilateral Investment Model, considers that the United States linked the investment rules and protection of human rights when signing the RTAs. China is the fourth practical case linking investment rules with human rights. It points out that the investment rules of RTAs signed by China are not linked to human rights. However, with the negotiation and signing of TPP, TTIP and BITs between China and the United States, China Perhaps to consider changing the current state of practice. Finally, the article analyzes the legal and political development trend of investment rules and human rights protection of RTAs, and puts forward some feasible suggestions on the international and domestic aspects.
