本文拟通过一则案例,分析法院拍卖划拨土地上建筑物后,建筑物善意受让人的权利如何保障的问题。法院不合程序的拍卖划拨土地使用权导致善意受让人的权利受损,在考虑防止国有土地流失和严格管理的同时,同样应当注意的是对于善意受让人权利的保护。不能偏废哪一个而忽视另一个,只有这样才能既坚持土地公有的基本制度,又使得土地能够得到充分利用,发挥其应有的经济价值。
This article intends to pass a case to analyze how the rights of the goodwill assignee of the building can be protected after being auctioned by the court for auctioning the buildings on the land. The court’s out-of-process auction of land-use rights has resulted in the loss of the rights of the bona fide assignee. In considering the prevention of the loss of state-owned land and the strict management, the same should be noted for the protection of the rights of the bona fide assignee. One can not neglect the other and neglect the other. Only in this way can we not only adhere to the basic public ownership of land, but also make the land fully utilized and give play to its due economic value.
