现行商事仲裁制度存在诸多弊端,上海自贸区仲裁纠纷解决机制进行了一系列创新,但仍存在临时仲裁和紧急仲裁庭制度规定不完善、开放仲裁员名册和仲裁第三人制度规定不健全、合并仲裁规定模糊、调解员和仲裁员角色混乱等问题。因此,应健全临时仲裁制度,赋予仲裁庭庭前审查权;重构仲裁员开放名册,明确仲裁员范围和资格审查;改革合并仲裁制度,健全仲裁第三人和调解与仲裁相结合制度,以完善商事仲裁纠纷解决机制。
There are many drawbacks in the current commercial arbitration system. A series of innovations have been made in the arbitration dispute resolution mechanism in Shanghai Free Trade Zone.
