近年来,关于见危不救和见义勇为却反受其害的新闻不绝于耳。对此,我们正遭受一种拷问:是否应当将道德义务法律化,比如增设“见危不救”罪,对那些能够给予救助却不愿救助的人冠上不作为犯罪的帽子,用法律的手段来维持一般的道德义务呢?在本文看来,回答这个问题必须从主客观角度全面分析道德义务法律化的可行性,进而提出可供参考的对策与建议。
In recent years, news of what to do but what to do about being benefactorsial and courageous has never ceased to be heard. In response, we are being subjected to a torture question: Should ethical obligations be legalized, such as the creation of a crime of “perilousness” and a crowning hat for those who can give aid but do not want to be helped? Legal means to maintain the general moral obligations? In this paper, the answer to this question must be from a subjective and objective perspective comprehensive analysis of the feasibility of the legalization of moral obligations, then put forward for reference countermeasures and suggestions.
