司法鉴定技术与方法准入就是要为新的技术和方法进入司法鉴定活动设置一道门槛,对司法鉴定实践中采用的技术和方法设立允许采用的条件。我国目前的司法鉴定技术和方法准入在立法、司法和行政上都处于管理缺乏的状态,因此,应当建立适合我国国情的司法鉴定技术与方法的准入体系,在立法上规定用于司法鉴定的技术和方法必须是科学可靠的,具体技术与方法的准入由人民法院负责审查,同时人民法院在作为技术准入决定时,要注意听取司法鉴定管理机关和有关行业组织的意见。 The access of forensic technologies and methods is to set a threshold for new technologies and methods to enter forensic activities and to set up the conditions that are allowed for the techniques and methods used in forensic practice.
