竞争法的目标,是指竞争法通过规范市场竞争而实现的功能。竞争法目标具有宣示性和导向性,明确的竞争法目标,可以减少或避免立法文件中的歧义、疏漏或失误,同时为法官们统一解释和适用竞争法规范提供一般指导原则。目前,世界上已有80多个国家制定了竞争法,自1990年以来已经有超过35个发展中国家和市场经济转型国家制定或实质性修改了竞争法。但无论在理论上还是在实践中,各国竞争法的目标都没有一个统一
The objective of competition law is the function that competition law realizes through regulating market competition. The aim of the competition law is declarative and guiding. The clear objectives of the competition law can reduce or avoid ambiguity, omission or mistake in the legislative documents. At the same time, it provides general guidance for the judges to uniformly interpret and apply the law of competition law. At present, over 80 countries in the world have enacted competition laws. Since 1990, more than 35 developing countries and countries with market economy transitions have enacted or substantively amended their competition laws. However, both in theory and in practice, the objectives of competition law in various countries are not unified
