随着劳动合同履约担保条款的普遍使用,因担保条款所带来的法律问题越来越受到人们的关注。本文通过分析劳动合同履约担保的涵义及存在的合理性,探讨如何对我国劳动合同履约担保条款加以规制,保证劳动合同担保作用的真正实现。
With the widespread use of the terms of the contract for performance of labor contract, the legal issues brought by the guarantee clause have drawn more and more attention. This article analyzes the meaning and existence rationality of the performance guarantee of the labor contract and discusses how to regulate the terms of the guarantee contract of the labor contract in our country so as to guarantee the true realization of the guarantee function of the labor contract.
