在新形势下,腐败犯罪已经在国家权力结构各个层面爆发出来。从控制理论上看,官场是一个高风险的职务犯罪行业,官员成为潜在的职务犯罪人。在这种现实下,观念的转变是至关重要的。从历史经验与社会发展看,腐败犯罪预防与治理的根本出路是中国特色的权力法治化,尤其是权力结构转型过程中有特色的法治演化过程。在对策上,应立足现实,进行调控制度创新,让权力在制度笼子中运行。
In the new situation, corruption crimes have erupted at all levels of the state power structure. From the control theory point of view, the officialdom is a high-risk job-related crime industry, and officials become potential job-holders. In this reality, the transformation of ideas is crucial. Judging from historical experience and social development, the fundamental way out for the prevention and management of corruption crimes is the rule of law with power with Chinese characteristics, especially the evolution of the rule of law featured in the transition of power structure. In response, we should base ourselves on reality and carry out innovation in regulation and control so that power runs through institutional cages.
