少数民族婚姻制度的一种法史学解读——以婚姻习惯不落夫家为考察对象

我国各地区少数民族的婚姻制度丰富多彩,形态各异。其中,曾盛行于南方少数民族地区的特殊婚姻习惯——不落夫家就颇具典型意义。在相当长的一段时期内,生活在广西、海南、贵州、云南、四川、湖南等区域内的十多个民族,都不同程度地存有这一带有母系社会特征的制度。从社会学角度来说,不落夫家虽然具有推迟妇女育龄、降低人口增长率等积极功能,但也带来了婚姻不稳定等一些弊端。在现代文明的影响下,不落夫家虽然被逐渐废除,但从法史学角度解读这一制度,对于揭示少数民族婚姻家庭制度的地域特点和发展脉络具有积极意义。 The marriage system of ethnic minorities in various regions of our country is rich and colorful with various forms. Among them, the special marital customs that prevailed in the southern ethnic minority areas - rather than husbands and husbands, are rather typical. For quite a long period of time, more than 10 ethnic groups living in Guangxi, Hainan, Guizhou, Yunnan, Sichuan and Hunan have their own systems of matriarchal levels to varying degrees. From a sociological point of view, not neglecting husbands, although possesses the positive function of postponing the women’s childbearing age and reducing the population growth rate, brings some drawbacks such as instability of marriage. Under the influence of modern civilization, although it is gradually abolished, the interpretation of this system from the angle of legal historiography has positive significance for revealing the regional characteristics and development context of the ethnic minority marriage and family system.
