全球治理理论的勃兴与2008年金融危机造成的影响,使得全球金融治理成为实务与理论上热门的议题。传统国际法渊源,如条约与国际惯例,不能满足全球金融治理的目标。由于全球治理理论与金融本身特性两方面的原因,全球金融治理对于软法有着特殊的需求,与其具有紧密的联系。在全球金融治理中,软法发挥着节约谈判成本、避免主权限制、允许政策偏好的分歧、提供统一的国际标准、回应现实不确定性以及为持续磋商做基础的重要作用。金融危机之后金融稳定委员会的重构证明了软法在全球金融治理中的作用,揭示了其在短期内的发展。可以肯定,众多的国际金融软法不可能在一夜之间消失,仍然将在具体领域发挥独特而重要的作用。
The booming of the theory of global governance and the impact of the financial crisis in 2008 have made global financial governance a hot issue in practice and theory. The origins of traditional international law, such as treaties and international conventions, can not meet the goal of global financial governance. Due to the two aspects of the theory of global governance and the nature of finance itself, global financial governance has special needs for soft law and is closely linked with it. In global financial governance, soft law plays an important role in saving negotiation costs, avoiding sovereign restrictions, allowing differences in policy preferences, providing uniform international standards, responding to real uncertainty and building the foundation for ongoing negotiations. The Reconstruction of the Financial Stability Committee after the Financial Crisis Proves the Role of Soft Law in Global Financial Governance and Reveals Its Development in the Short Term. To be sure, numerous international financial soft law can not disappear overnight, and will still play a unique and important role in specific fields.
