知识产权(又称智慧产权)是指对智力劳动成果所享有的占有、使用、处分和收益的权利。知识产权是一种无形财产权,它与房屋、汽车等有形财产一样,都受到国家法律的保护,都具有价值和使用价值。智力劳动成果必须经过法律规定的程序授予权力才能称之为知识产权。专利是专利权的简称,它是国家按专利法授予申请人在一定时间内对其发明创造成果所享有的独占、使用和处分的权利。它是一种财产权,是运用法律保护手段“跑马圈地”、独占现有市场、抢占潜在市场的利器。2003年10月1日,中华人民共和国专利申请号由原有的8位数升至12位数。1985年4月1日起实施《中华人民共和国专利法》。使用了18年的8位数专利申请号已成为历史。专利申请号的升位,表明我国发明创造、技术创新已达到新的规模,中国市场的开放和国际化程度进一步提高,中国已经进入专利申请大国的行列。可能对于每个公民来说,也许电话号码的升位才是与自己的生活息息相关的,对于一个专利的号码究竞是8位还是12位的,没有那么的重要。但是对于一个国家,对于一个发展中的大国来说,专利申请号码的升位,不仅仅代表着一个专利大国的荣誉和地位,更重要的是代表着对于知识产权的保护态度和国家对专利申请者的保护。入世已经两年,在这两年中,国人对于各大媒体关于知识产权的报道可以说是已经耳熟能详。为方便读者了解专利知识及专利申请号升位后的有关情况,本刊组织了这篇文章,希望能有所启发。
