当前,新闻侵权成为新闻业面临的重要法律问题之一,已对市场经济形势下新闻业的发展形成一种挑战。新闻侵权行为的相关法律问题也在法学界、新闻界等社会各界受到普遍关注。我国政府从20世纪80年代起启动了《新闻法》的起草工作,并提出了立法草案和立法框架。新闻媒体在传播信息,报道消息,引导舆论,社会监督等各个方面都担负着重要的社会责任。在履行社会责任的同时,日益增多的与社会各方面的纠纷就难以避免。体现在新闻传播活动中:一方面是新闻工作者的权益被侵害;另一方面则是新闻工作者侵害他人权利的行为时有发生。新闻工作的维权的问题应该得到社会的全面关注,新闻侵权也应该引起我们的高度重视,特别是在预防上不可大意。本文阐述了新闻侵权的概念及新闻侵权的表现,并就如何避免新闻侵权的发生进行了深入细致的探讨,对新闻工作者在日常的新闻从业过程中有一定的启发作用。
At present, news infringement has become one of the important legal issues facing the news industry, which has posed a challenge to the development of the news industry in the market economy. Relevant legal issues concerning news infringement have also drawn widespread attention in various circles in the legal and journalistic fields. Since the 1980s, my government started the drafting of the “Press Law” and put forward the draft legislation and the legislative framework. The news media are responsible for important social responsibilities in all aspects of disseminating information, reporting news, guiding public opinions, and supervising social affairs. While fulfilling their social responsibilities, the ever-increasing number of disputes with all sectors of society will be unavoidable. Reflected in the news dissemination activities: on the one hand, the rights and interests of journalists have been violated; on the other hand, journalists have infringed the rights of others. The issue of safeguarding the rights of journalism deserves the full attention of the society. The media infringement should also attach great importance to us, especially in the area of prevention. This article elaborates the concept of news infringement and the performance of news infringement. It also discusses in detail how to avoid the infringement of news infringement, and gives some enlightenment to journalists in daily journalistic practice.
