在中国现阶段,劳动者的利益诉求以相对温和型方式为主,主要包括:诉诸法律的方式;静坐、请愿、上访、游行、散步等方式;停工、罢工的方式;分散性的而且是一事一议的方式。劳动者之所以侧重选择温和型的利益诉求方式,大致原因是:劳方希冀与资方在共生共存的前提下解决问题;劳资矛盾的核心是经济利益而非政治权利;中国现阶段劳动者自身具有一些特有的情状,如劳动者的忍耐性相对较强、流动程度较高,大多数试图表达自己利益诉求的劳动者十分在意自己行为的“安全性”问题,大多数农民工还有着最为基础性的生计来源。防止劳动者采取激烈的利益诉求方式的根本在于建立起公正合理的劳资关系。从中近期看,防止劳动者采取激烈的利益诉求方式的关键是将劳资矛盾的解决纳入制度化的轨道,注重以制度化解劳资矛盾。
