南共体法院自2005年8月开始运作,它受理的第一个案件是津巴布韦“土地征收案”。该案明晰了南共体法院的运作过程,及在此过程中所暴露出来的问题。它主要表现在两方面:一是南共体法院目前的管辖权过于宽泛,有干涉成员国内政之嫌;二是南共体法院判决的执行缺乏有效的保障措施,这会影响地区一体化的实现。要使南共体法院真正成为推动地区一体化的有力工具,南共体首脑会议必须对有关南共体法院管辖权及其执行判决的规定进行修订,而南共体法院本身也应当限制自己的管辖权。
The SADC Court has been operating since August 2005 and the first case it has accepted is Zimbabwe’s Land Expropriation. The case clarified the operational process of the SADC Court and the problems exposed in the process. It is mainly manifested in two aspects: First, the current jurisdiction of the SADC courts is too broad and there is suspicion of interfering in the internal affairs of member states; second, the lack of effective safeguards in the implementation of the SADC judgments will affect the realization of regional integration . In order for SADC courts to truly become a powerful instrument for promoting regional integration, the SADC summit must revise the provisions on the jurisdiction of the SADC courts and their enforcement judgments, and the SADC courts themselves should limit their own jurisdiction.
