本文所探讨的是在采用英文原文判例教材进行教学的过程中经常会遇到的问题,主要包括以下两个方面:1.如何对原文案例进行选取和剪裁。关于案例的选取,本文首先介绍了查找原文案例的渠道,继而讨论了选取这类案例时应遵循的原则。关于案例的剪裁,本文重点介绍了英美法系国家的法院判决所含的基本成分和对其各个成分进行剪裁时应注意的问题。2.本文谈到,应该注意引导学生积累国外法律中的核心概念和术语,包括有关特定制度的概念、英美普通法上的概念、英美衡平法上的概念、法律程序术语、国际流行的法律概念。
This article discusses the problems encountered in the process of using English original textbook to teach, which mainly includes the following two aspects: 1. How to select and cut the original case. With regard to the selection of cases, this article first introduces the channels for finding original cases and then discusses the principles to be followed in selecting such cases. With regard to the clipping of cases, this article focuses on the basic elements contained in the judgments of common-law countries in the Anglo-American legal system and issues that should be paid attention to when tailoring their respective components. 2. This article talks about the importance of guiding students to accumulate core concepts and terms in foreign law, including concepts related to specific institutions, common law concepts in Anglo-American law, Anglo-American notions of equity, legal terminology, legal concepts of international popularity .
