近年来,未成年人犯罪已经成为当今世界一个普遍存在且十分严重的社会问题。很长时间以来,未成年人犯罪率一直居高不下,成为影响国家稳定和经济发展的重要社会问题之一。虽然理论界对此问题进行了长期而大量的研究,形成了一系列重要的学术成果,也为司法实务提供了借鉴,但总体来讲,专门从刑法学立法的角度对未成年人犯罪进行论述的论文并不太多。本文正是在借鉴各国学者丰硕研究成果的基础上,通过对我国现行刑法关于未成年人犯罪存在问题的分析研究,在刑法实体方面提出完善我国未成年人犯罪的刑法立法建议,从而达到进一步预防和减少未成年人犯罪的目的。
