《中华人民共和国反垄断法》(以下简称《反垄断法》)自2008年8月1日施行以来,一直备受社会各界关注。《反垄断法》对私人主体针对垄断行为人提起民事诉讼的问题作了概括性的规定:“经营者实施垄断行为,给他人造成损失的,依法承担民事责任。”该条的规定尽管过于简略,但它为我国反垄断民事诉讼制度预留了较大的发展和完善空间,具有积极的意义。
The Antitrust Law of the People’s Republic of China (hereinafter referred to as “Antitrust Law”) has been drawing much attention from all sectors of society since its implementation on August 1, 2008. The “Anti-monopoly Law” provides a general rule for the private subject to file a civil lawsuit against the monopolist: “If a manager monopolizes the enterprise and causes losses to others, it shall bear civil liability in accordance with the law.” It is too simple, but it reserves a great space for development and improvement of China’s antitrust civil litigation system, which has positive significance.
