居住权存在可以追溯到罗马法时期,随着商品经济的发展,大陆法系和英美法系大部分国家都规定了居住权制度。但是,我国居住权制度的建立仍然存在争议。虽然我国没有建立居住权制度,但是,我国有建立居住权的可行性和必要性。根据居住权的属性,我国在立法体例和内容上应该从救济性居住权和投资性居住权两方面考虑,以便完善我国物权法的内容和不断发展的市场经济。本文主要采取归纳分析的方法,实证分析方法,比较分析方法等方法对居住权进行了浅析。
The existence of residency can be traced back to Roman law. With the development of the commodity economy, the civil law system and most countries in the common law system stipulate the system of residency rights. However, the establishment of China’s housing rights system is still controversial. Although China has not established a system of residency rights, however, our country has the feasibility and necessity of establishing residency rights. According to the property right of residence, our country should consider both the residency right and the investment residency in the legislation system and content, in order to perfect the content of the real right law of our country and the developing market economy. This article mainly adopts the methods of inductive analysis, empirical analysis, comparative analysis and other methods to analyze the residency right.
