为应对当今网络时代中,知识产权流动性不断增强所导致的司法实践中出现的种种问题,各国纷纷进行研究并通过了一系列关于知识产权领域的法律适用原则,而其中最具代表性的当属美国法律协会制定的《ALI原则》,日韩国际私法学会制定的《知识产权国际私法原则》与德国马克斯普——朗克研究所制定的《CLIPS原则》。国内已有的文章更多的是针对前二者的探讨分析,但对于耗时最长、条文内容最为详尽的《CLIPS原则》目前却没有专门的述评。本文旨在对《CLIPS原则》中关于管辖权、法律适用和外国法院判决的承认与执行的相关规定进行分析,力图把握知识产权法律冲突的发展趋势,并从中找寻适合我国学习借鉴的内容。
In order to cope with various problems in judicial practice caused by the ever-increasing flow of intellectual property in the Internet age, various countries have studied and passed a series of principles on the application of law in the field of intellectual property. The most representative ones The “ALI Principles” developed by the American Law Association, the “Principles of Private International Law of Intellectual Property Rights” formulated by the Japan-South Korea Institute of International Private Law and the “CLIPS Principles” formulated by the Max Planck Institute for German Studies. However, there is no specific comment on the most time-consuming and most detailed “CLIPS Principles” currently in the country. The purpose of this paper is to analyze the relevant provisions of the CLIPS Principles on the jurisdiction, the application of law and the recognition and enforcement of foreign court judgments, and try to grasp the development trend of the legal conflicts of intellectual property and find the suitable content for our country to learn from.
