论受教育权纠纷及其解决机制的重构——以高等教育为视角

受教育权是公民享有的一项基本权利。在实践中,由于教育思维及受教育权纠纷解决机制方面的原因,出现了诸多的受教育权纠纷。要化解受教育权纠纷,就需要对受教育权、受教育权涉及的法律关系、受教育权纠纷的性质等问题进行梳理,厘清受教育权涉及的法律关系,明确界定受教育权纠纷所属的性质,进而寻找产生纠纷的原因,分析我国现有受教育权纠纷解决机制存在的缺陷,并构建一个包括协商交涉、申诉、诉讼在内的完整的、规范化的解纷机制,以实现校园和谐。 The right to education is a basic right enjoyed by citizens. In practice, many disputes over the right to education have emerged due to educational thinking and the dispute resolution mechanism of the right to education. To resolve the dispute over the right to education, we need to sort out the legal issues concerning the right to education, the legal relationship involved in the right to education, and the nature of the dispute over the right to education. We should clarify the legal relations involved in the right to education, clearly define the disputes And then find out the causes of the disputes, analyze the defects of the existing dispute resolution mechanism of education right in our country, and construct a complete and standardized dispute resolution mechanism including negotiating, petitioning and litigation so as to realize campus harmony.
