后金融危机时代,要使金融业充分地活跃起来,逐渐摆脱命运危困的阴影,最重要的课题之一即是强化保护金融消费者的立法,重树大众对金融市场的信任。针对此主题,本文总结了现实立法改革中的起步困境,并选择几个重点问题加以探索:第一是完善对策之出发基点问题,在此问题中文章尝试厘清金融消费者的概念;第二是保护体系之完整化设计问题,在此部分本文探进了软法与硬法机制的有效结合;第三是核心权利之制度构塑问题,即金融消费者知情权的保障问题。对前述若干重点问题的研究,旨在挖掘立法完善进路,以求与其他学者商榷。
In the post-financial crisis era, one of the most important tasks to make the financial industry fully active and gradually emerge from the shadow of fate is to strengthen the legislation to protect financial consumers and restore the public’s trust in the financial markets. In response to this theme, this article summarizes the starting difficulties in the real legislative reform, and selects several key issues to explore: the first is to improve the starting point of the problem, in this issue, the article attempts to clarify the concept of financial consumers; the second is In this part, this paper explores the effective combination of the soft and hard law mechanisms. The third is the system of core rights issues, that is, the protection of the financial consumer’s right to know. The study on some of the key issues mentioned above aims to find ways to perfect the legislation so that it can be discussed with other scholars.
