随着世界范围内贸易自由化进程的推进,传统的非关税壁垒的作用被逐步削减,绿色贸易壁垒以其鲜明的时代特征日益成为国际贸易发展的主要技术性贸易壁垒。它是一把双刃剑,一方面体现了消费者保护环境、维护健康等正当合理的要求,另一方面又可以成为某些国家推行新的贸易保护主义、阻止外国商品进口的“挡箭牌”。法经济学认为,处理经济问题的法律规则,其实质内容的合理性和必要性,应靠科学的经济理论与实践来鉴别。本文运用法经济学供给需求、成本收益、公共选择等理论,对绿色贸易壁垒进行规范分析和实证分析,探讨绿色贸易壁垒的形成机制及其制度的公平性和效率。
With the progress of trade liberalization in the world, the role of traditional non-tariff barriers has been gradually reduced. With its distinctive characteristics of the times, green trade barriers are increasingly becoming the major technical barriers to trade in international trade. It is a double-edged sword, on the one hand reflects the consumer to protect the environment, to maintain health and other legitimate needs, on the other hand it can become some countries to promote new trade protectionism, to prevent the import of foreign goods ". According to law and economics, the rationality and necessity of the substantive content of the legal rules for handling economic problems should be distinguished by scientific economic theory and practice. Based on the theory of supply and demand, cost and benefit, and public choice, the paper analyzes normatively the green trade barriers and discusses the formation mechanism of green trade barriers and the fairness and efficiency of the system.
