自《城市生活无着的流浪乞讨人员救助管理办法》实施以来,很多城市出现了流浪乞讨人员明显增多的现象,并给城市带来了一些负面影响。于是,一些城市的市政管理部门纷纷表示要“禁乞”。沈阳,苏州、南京、西安等地纷纷出台了有关“禁乞”的规定。在学界,对乞讨是否能作为一项权利也展开了激烈的争论,众说纷纭,莫衷一是。本文就乞讨能否作为一项权利进行法理上的探讨。
Since the implementation of the “Measures for the Aid and Management of Wandering and Begging People Without Urban Life”, many cities have witnessed a marked increase in the number of vagrants and beggars, with some negative impacts on the cities. As a result, municipal administrations in some cities said they would “ban money”. Shenyang, Suzhou, Nanjing, Xi’an and other places have promulgated the “begging begging” requirement. In academia, there is a wide range of controversies over whether begging can be a right or not. This article discusses whether begging can be regarded as a right in law.
