司法的目标是和平、和谐、公平与正义,而实现的手段却是斗争,是司法的公信力与拘束力。司法的生命是以人为本的,即国民的、国家权力的、阶级的、个人的人本关怀。而司法之公信力和拘束力是司法权威获得普遍服从的两大资源,失去了这两大资源,也就等于失去了法精神,失去了法精神也就意味着失去了整个社会人本关怀与法道德和谐的基础,故司法精神的人本关怀便是司法权威的核心要素之所在。
The goal of justice is peace, harmony, fairness and justice, but the means to achieve it is the struggle and the credibility and binding force of the judiciary. The life of the judiciary is people-oriented, that is, people-centered, state-power, class, and individual humanistic care. However, the credibility and binding power of the judiciary are two major sources of universal obedience to judicial authority. Losing these two major resources means losing the spirit of law. Losing the spirit of law also means losing the care and law of the entire community The basis of moral harmony, so the judicial spirit of the people-oriented care is the core element of judicial authority lies.
