不动产领域的物权登记规则主要存在登记生效与登记对抗两种模式,本文通过对登记制度的法理基础介绍、各国相关立法模式对比分析、我国立法现状分析,得出登记对抗主义为特定历史背景下物权变动模式的选择,登记生效主义更加适合我国经济与法律现状。同时针对物权法上地役权与农村土地承包经营权的登记对抗规则进行探讨,认为在继受德国民法模式的前提下,我国应完成不动产登记生效制度的一体化工作。
