整体而言,国家经济安全面临着两种法律风险:法律责任风险和法律奉行风险。这里以中国加入世贸组织的服务贸易总协定(GATS)为例,说明国家经济安全面临的两种法律风险及其与特定法律权利义务的关系。中国在模式一项下的特定承诺是作了精心选择的,但这些选择在承诺的兑现、应对进一步自由化的压力、科技及经济创新、利用世贸组织规则等方面面临着较多的法律责任风险,在对已承诺和未承诺部门的控制上面临着较多的法律奉行风险。这两种风险的界定可以为进一步控制国家经济安全中的法律风险提供一个基本的分析框架。
Overall, the country’s economic security is faced with two legal risks: the risk of legal liability and the law of risk. The definition of these two risks can provide a basic analytical framework for further controlling the legal risks in the economic security of a country.
