社会管理创新,是指社会管理理念的更新、主体的拓展、客体的扩充以及治理手段的多元化。在法治思维下,首先应当建设法治政府,即从社会管理(管制)型政府建成社会治理服务型政府,即要求在每一社会领域内均实现政府职能的转变,全面实施依法行政以适应变革中社会现实的要求。通过社会管理创新与政府职能重新定位、行政活动的多元化、社会组织的培育以及社会矛盾纠纷解决机制的完善等,总结出从社会管理到社会治理、从传统公共行政到现代服务行政的规律性内容;在社会改革实践的同时,也推动行政法理论的发展。
