《保护非物质文化遗产公约》(中译本)在非遗传承主体的表述上与《公约》(英文版)的表述存在着概念逻辑关系的不一致,属误译。《公约》所提非遗定义与日语“無形文化財”存在着联系。非遗传承主体的概念之间是属种关系而非否定关系。误译产生的原因系词义固化所造成。 The Convention on the Protection of the Safeguarding of the Intangible Cultural Heritage (Chinese Version) contains inconsistencies in the conceptual and logical relations with the expressions of the Convention (English version) in the expression of non-genetic heritage and is a mistranslation. The definition of non-consensuality in the Convention is related to Japanese “intangible cultural assets.” The concept of non-genetic heritage is a genus relationship rather than a negative one. The reason of mistranslation is caused by the semantic curing.
