奈特说:“天下没有免费的午餐”。午餐费用,或为主人之慷慨,或为客人自掏腰包,知识产权保护制度的实施与执行也不例外。当前一个不争的事实是,几乎所有发展中国家都在为发达国家提供实施知识产权保护的“免费午餐”:一方面承担高额的执行成本,一方面眼睁睁地任其攫取巨额的垄断利润满载而归。那么,为知识产权保护制度存在和执行产生的成本到底应当由谁承担?
